These terms cover your use of this website. They do not cover the work we do for clients. That work is governed by the separate written agreement signed before it starts.
Agreement to these terms
This website is operated by DANIEL MOSHE LLC, a Delaware limited liability company doing business as XPrime Media. By using this site you agree to these terms. If you do not agree, please do not use the site.
What this site is
This site describes services we offer and gives you a way to contact us. Nothing on this site is an offer, a quote, or a contract. A working relationship begins only when both sides sign a written agreement that names the scope, the price and the terms.
No guarantee of results
We describe what we do, not what you will earn. Specifically:
- We do not guarantee search engine rankings, traffic volume, lead volume, appointment volume, sales, or revenue.
- Any figure discussed with you is an illustration built from numbers you provide, not a forecast and not a promise.
- Results depend on factors outside our control, including your market, your pricing, your capacity, your response time, your close rate, and the policies of advertising platforms.
- Advertising platforms may change their rules, costs or approvals at any time.
Submitting the form
When you submit the contact form you confirm that the information is accurate, that you are at least 18, and that you are authorised to give the phone number and email address you entered. How we handle what you send is described in the Privacy Policy.
Acceptable use
Do not use this site to:
- Break the law, or help anyone break it
- Send false, misleading or automated form submissions
- Attempt to access parts of the site that are not public
- Interfere with the site, probe it for weaknesses, or overload it
- Scrape or copy the content for a competing service
Intellectual property
The content of this site, including text, layout, design, code, the XPrime Media name and the XPrime Media logo, belongs to DANIEL MOSHE LLC or is used with permission. You may view and print pages for your own evaluation. You may not republish, resell, or use them commercially without written permission.
The sample appointment shown on the home page contains fictitious demonstration data. Any resemblance to a real person is coincidental.
Third party names and links
Product and platform names on this site, including Meta, Google and others, belong to their respective owners. Naming a platform describes the tools we work in. It does not claim endorsement, partnership or certification by that company unless the site says so explicitly.
If this site links to another website, we are not responsible for that site's content or practices.
Disclaimer
This site is provided as is and as available, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the site will be uninterrupted, error free, or free of harmful components. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, DANIEL MOSHE LLC and its owner will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, or business opportunity, arising out of your use of this site, even if we were advised such damages were possible.
Our total liability arising out of or relating to this site will not exceed one hundred United States dollars (US$100). Liability under a signed client agreement is governed by that agreement, not this one.
Indemnity
You agree to indemnify and hold harmless DANIEL MOSHE LLC and its owner from claims, damages and reasonable legal fees arising out of your misuse of this site or your breach of these terms.
Billing and refunds
How you are charged, when an appointment is replaced at our cost, and how refunds and disputes are handled, are set out on the Billing, Cancellations and Refunds page, which forms part of these terms.
Governing law and venue
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute relating to this site will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
Severability and waiver
If a provision of these terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it.
Changes
We may update these terms. The effective date at the top shows the current version. Continuing to use the site after a change means you accept it.
